Terms and Conditions
These Terms and Conditions govern your use of the AARAGOLD platform, operated by Moi Technology Private Limited. By registering or using the platform, you agree to be legally bound by these terms. If you do not agree, please discontinue use immediately.
1. THE SERVICE
AARAGOLD is a distributor facilitating the purchase, sale, and storage of digital gold (“Gold”). Gold services, including vaulting and fulfillment, are managed by Moi Technology and its partners. AARAGOLD acts only as a facilitator and is not liable for disputes arising directly from gold transactions or third-party service providers.
2. ELIGIBILITY & REGISTRATION
- Age: You must be 18+ years old to use this Platform.
- Accuracy: You agree to provide accurate personal and financial information (Name, PAN, Bank details). Providing false data may result in account termination
- Security: You are solely responsible for maintaining the confidentiality of your account and for all activities under your credentials.
3. PLATFORM USAGE & KYC
- A limited, non-transferable license is granted for personal use only.
- KYC: Verification (PAN/Digilocker) is mandatory for withdrawals, physical delivery, or high-value transactions to prevent fraud.
- Prohibited Acts: You may not scrape data, reverse-engineer the app, or use the platform for any unlawful purpose.
4. PRICING & PAYMENTS
- Prices are linked to commercial bullion markets and may fluctuate multiple times daily.
- Transactions are only confirmed upon successful receipt of funds in the Company's account. Gold will be credited to your account within 5 business days of payment.
5. DELIVERY & STORAGE
- Physical Delivery: Requires a valid address and ID verification.
- Storage Limits: Gold must be claimed within the "Maximum Storage Period." If unclaimed after the "Grace Period," the Company may sell the gold at market rates and hold the proceeds (minus charges) for you for up to 3 years.
6. CANCELLATIONS & REFUNDS
- Lock-in: There is no minimum lock-in period, but withdrawals are only permitted 24 hours after the investment.
- Finality: Once a payment is confirmed, it is binding and cannot be cancelled.
7. MANDATORY UNPACKING VIDEO
To process claims for missing or damaged items, a clear, uninterrupted unpacking video is mandatory. The video must:
- Show the package in its unopened state (including seals/labels).
- Capture the entire process without cuts or pauses.
- Clearly show the contents (coin and documents). Claims without this video evidence will be considered void.
8. LIMITATION OF LIABILITY & INDEMNITY
- No Advice: Content on the Platform is for information only and does not constitute investment advice.
- As-Is: The Platform is provided "as-is" without warranties of uninterrupted service.
- Indemnity: You agree to indemnify AARAGOLD against any losses arising from your breach of these terms or misuse of the platform.
9. GOVERNING LAW & DISPUTES
These terms are governed by Indian law. Any disputes are subject to the exclusive jurisdiction of the courts in Thoothukudi, India, and shall be resolved through mediation as per the Consumer Protection Act, 2019.
